KVKK Information Notice

How we process personal data under the Turkish Personal Data Protection Law No. 6698 ("KVKK").

1. Data controller

The data controller is Nastech FZCO, Dubai, United Arab Emirates (X2 Tower, Office 3505, JLT, Dubai, UAE), which operates this website. Email: sales@nastechsolar.com.

Data controller representative in Turkey: TURAS Mühendislik ve End. Sist. San. Tic. Ltd. Şti., Esentepe Mah. Büyükdere Cad. No: 193 İç Kapı No: 5, Şişli / İstanbul.

2. Personal data we process

  • Identity: name and surname.
  • Contact: email address, phone and WhatsApp number.
  • Professional details: company name, role, country and city.
  • Customer transaction data: quote and order requests, products and quantities, serial numbers, purchase and installation details, warranty claims and our correspondence with you.
  • Visual records: photos and videos you upload with a warranty claim.
  • Account data: login details for your customer account.
  • Transaction security data: IP address, browser and log records, and cookie data as described in our Cookie Policy.

We do not ask for special categories of personal data (for example health data). Please do not send them through our forms.

3. Purposes of processing

  • Answering quote, contact and dealer applications, and preparing offers
  • Setting up and managing customer accounts
  • Handling warranty claims, including checking serial numbers and passing claims to the manufacturer
  • Arranging orders and deliveries with our distribution partner in Turkey
  • Keeping the website and our systems secure
  • Meeting our legal obligations and handling legal claims
  • Sending product and campaign information, only if you have given separate consent

4. Legal basis

We process personal data on the grounds in Article 5(2) of KVKK: where it is necessary to set up or perform a contract with you (c), to meet a legal obligation (ç), to establish, exercise or protect a right (e), or for our legitimate interests, provided this does not harm your fundamental rights and freedoms (f). Marketing messages are sent only with your explicit consent (Article 5(1)).

5. Transfers of personal data

We may share personal data with:

  • our distribution partner in Turkey, to process orders, deliveries and warranty returns;
  • product manufacturers, to assess and settle warranty claims;
  • service providers that host and run our website, email and business software;
  • public authorities, where the law requires it.

As the data controller is based in the United Arab Emirates, and some manufacturers and service providers are located outside Turkey, personal data is transferred abroad. These transfers are made on the conditions of Article 9 of KVKK, including standard contracts where required.

6. How we collect personal data

We collect personal data through the forms on this website, your customer account, email, WhatsApp and phone, and automatically through cookies and similar technologies.

7. How long we keep it

We keep personal data for as long as needed for the purposes above and for the periods required by law (for example, commercial records), and then delete, destroy or anonymise it.

8. Your rights

Under Article 11 of KVKK you have the right to:

  • learn whether your personal data is processed, and request information about it;
  • learn the purpose of processing and whether it is used for that purpose;
  • know the third parties in Turkey or abroad to whom it is transferred;
  • ask for incomplete or incorrect data to be corrected;
  • ask for your data to be deleted or destroyed under Article 7 of KVKK;
  • ask for corrections, deletions or destructions to be notified to the third parties who received your data;
  • object to a result against you that arises only from automated analysis of your data;
  • claim compensation if you suffer damage because of unlawful processing.
